Judge Hawthorne: We are here today to hear the matter of Chen v. for Immigration Citizenship and Multicultural Affairs, where the applicant is appealing a decision by the Administrative Appeals Tribunal to affirm the refusal of a partner visa on character grounds. Mr. Miller: Thank you, Your Honour. We contend that the Tribunal made a jurisdictional error in refusing the applicant's partner visa application, and that the decision must be quashed. This error pertains to the Tribunal's disregard for mandatory considerations set out in Ministerial Direction No. 90, specifically concerning the best interests of the applicant's two young children, both of whom are Australian citizens. In doing so, the Tribunal exceeded its lawful authority and fundamentally misapplied the law.
